ভাৰতত ধৰ্ষণ (ইংৰাজী: Rape in India) নাৰীৰ বিৰুদ্ধে সংঘটিত কৰা অপৰাধৰ চতুৰ্থ স্থানত আছে। [1][2] নেশ্যনেল ক্ৰাইম ৰেকৰ্ডছ ব্যুৰোৰ ২০২১ চনৰ বাৰ্ষিক প্ৰতিবেদন অনুসৰি সমগ্ৰ দেশতে ৩১,৬৭৭টা ধৰ্ষণৰ গোচৰ পঞ্জীয়ন হৈছে, অৰ্থাৎ দৈনিক গড়ে ৮৬টা গোচৰ পঞ্জীয়ন কৰা হৈছে, যিটো ২০২০ চনৰ তুলনাত ২৮,০৪৬টা গোচৰ বৃদ্ধি পাইছে। আনহাতে ২০১৯ চনত ৩২,০৩৩টা গোচৰ পঞ্জীয়ন হৈছিল। [3] ২০২১ চনৰ মুঠ ৩১,৬৭৭টা ধৰ্ষণৰ গোচৰৰ ভিতৰত ২৮,১৪৭ (প্ৰায় ৮৯%) ধৰ্ষণ ভুক্তভোগীৰ চিনাকি ব্যক্তিয়ে সংঘটিত কৰিছে। যিসকল ভুক্তভোগী নাবালক বা বৈধ বয়স ১৮ বছৰৰ তলৰ, তেওঁলোকৰ অংশ ১০%। [4]

ভাৰতক "জনমূৰি ধৰ্ষণৰ হাৰ সৰ্বনিম্ন" দেশসমূহৰ ভিতৰত অন্যতম হিচাপে চিহ্নিত কৰা হৈছে। [5][6][7][8] বিবাহৰ ভুৱা প্ৰতিশ্ৰুতিৰ ভিত্তিত সন্মতিসূচক যৌন সম্পৰ্ককো চৰকাৰে ধৰ্ষণ বুলি শ্ৰেণীভুক্ত কৰে। [9] কেইবাটাও কাণ্ডই সংবাদ মাধ্যমৰ ব্যাপক দৃষ্টি আকৰ্ষণ কৰাৰ পিছত আৰু স্থানীয় আৰু দেশজোৰা জনসাধাৰণৰ প্ৰতিবাদৰ সূচনা কৰাৰ পিছত শেহতীয়া বছৰবোৰত ধৰ্ষণৰ খবৰ দিয়াৰ ইচ্ছা বৃদ্ধি পাইছে। [10][11][12][13][14] ইয়াৰ ফলত চৰকাৰে ধৰ্ষণ আৰু যৌন নিৰ্যাতনৰ অপৰাধৰ দণ্ডবিধিৰ সংস্কাৰ সাধন কৰে। [15]

এনচিআৰবি ২০২১ৰ পৰিসংখ্যা অনুসৰি ভাৰতৰ ৰাজ্যসমূহৰ ভিতৰত ৰাজস্থানত সৰ্বাধিক ধৰ্ষণৰ ঘটনা সংঘটিত হৈছে; দ্বিতীয় আৰু তৃতীয় স্থানত আছে ক্ৰমে মধ্যপ্ৰদেশ আৰু উত্তৰ প্ৰদেশ। মহানগৰসমূহৰ ভিতৰত দেশৰ ৰাজধানী দিল্লীত ২০২১ চনত ১২২৬টা ধৰ্ষণৰ ঘটনাৰে সৰ্বোচ্চ স্থানত থাকে। আনহাতে জনমূৰি হিচাপত সৰ্বাধিক ধৰ্ষণ ঘটনা সংঘটিত হয় জয়পুৰত, প্ৰতি এক লাখ জনসংখ্যাৰ বিপৰীতে ৩৪। আনহাতে কলকাতাত ধৰ্ষণৰ হাৰ সৰ্বনিম্ন পঞ্জীয়ন কৰা হৈছে; মহানগৰখনৰ জনমূৰি ধৰ্ষণৰ হাৰো সৰ্বনিম্ন। [4]

ভাৰতীয় দণ্ডবিধি অনুসৰি ধৰ্ষণৰ সজ্ঞা[সম্পাদনা কৰক]

২০১৩ চনৰ ৩ ফেব্ৰুৱাৰীৰ পূৰ্বে ভাৰতীয় দণ্ডবিধিৰ ৩৭৫ নং ধাৰাত ধৰ্ষণৰ সংজ্ঞা এনেদৰে দিয়া হৈছিল: [16][17] এজন পুৰুষে "ধৰ্ষণ" কৰা বুলি কোৱা হয়, নিম্নলিখিত ছয়টা বৰ্ণনাৰ যিকোনো এটাৰ অধীনত পৰা পৰিস্থিতিত এগৰাকী মহিলাৰ সৈতে যৌন সম্ভোগ কৰে:- [18]
১) মহিলাগৰাকীৰ ইচ্ছাৰ বিৰুদ্ধে।
২) মহিলাগৰাকীৰ সন্মতি অবিহনে।
৩) মহিলাগৰাকীৰ সন্মতি সাপেক্ষে, কিন্তু সেই সন্মতি যেতিয়া মৃত্যু বা আঘাতৰ ভয় দেখুৱাই আদায় কৰা হয়।
৪) যেতিয়া পুৰুষজনে জানে যে তেওঁ মহিলাগৰাকীৰ স্বামী নহয়, অথচ মহিলা গৰাকীয়ে সন্মতি দিয়ে, কিয়নো তেওঁ (তাই) বিশ্বাস কৰে যে তেওঁৰ পুৰুষজনৰ সৈতে বৈধভাবে বিবাহিত।
৫) মহিলাগৰাকীয়ে সন্মতি দিছে, কিন্তু যদিহে তেওঁ (তাই) মানসিকভাবে অসুস্থ বা নিচাগ্ৰস্থ অৱস্থাত পৰিণতি নুবুজাকৈ সন্মতি দিয়ে।
৬) মহিলাগৰাকীয়ে সন্মতি দিছে, কি্ন্তু যদিহে তেওঁৰ বয়স ষোল বছৰৰ তলত।
